What is Workmen Compensation Insurance?

Workmen Compensation Insurance โ€” also known as Employees' Compensation Insurance โ€” pays out when an employee is injured, falls ill, or dies because of their job. However careful a business is, accidents on a factory floor or a construction site do happen.

Say a labourer on a site is hurt because material falls from scaffolding above. Without this cover, the employee could take the business to court for medical costs and damages โ€” an expense that falls entirely on the employer. With the policy in place, the insurer steps in instead.

This isn't just a matter of choice โ€” the Employees' Compensation Act, 1923 already makes employers liable for such compensation. The policy simply ensures that liability doesn't come out of the business's own pocket.

Also known as

Workmen Compensation Insurance is commonly referred to as Employees' Compensation Insurance, WC Insurance, Employee Compensation Policy, or Workmen Compensation Policy. These terms are often used interchangeably and refer to insurance that protects employers against their statutory liability under the Employees' Compensation Act.

Why your business needs it

Even with strict safety measures in place, workplace accidents happen โ€” a fall at a construction site, a machinery mishap on a factory floor, or a health issue linked to working conditions. When they do, the Employees' Compensation Act, 1923 makes the employer legally responsible for compensating the affected worker.

A Workmen Compensation Policy transfers this financial liability to an insurer, so an accident doesn't turn into an unplanned expense for the business โ€” while also helping the affected employee access timely medical care and support.

Workmen Compensation Insurance โ€” FAQs

Is Workmen Compensation Insurance mandatory?
In many cases, yes. Employers have a legal responsibility to compensate employees for work-related injuries, disabilities, or death under the Employees' Compensation Act, 1923. A Workmen Compensation Policy helps transfer that financial liability to the insurer.
Are contract workers covered?
Yes, they can be covered, provided they are properly declared under the policy. Since contract labour arrangements vary from business to business, it's important to structure the policy correctly before it is issued.
What does the policy cover?
The policy generally covers the employer's legal liability towards employees arising from work-related injuries, occupational diseases, permanent or temporary disability, and death, as provided under the Employees' Compensation Act.
How is the compensation amount calculated?
Compensation is determined according to the Employees' Compensation Act, based on factors such as the employee's monthly wages, age, type of injury, and the extent of disability. The insurer settles the employer's legal liability as per these statutory provisions.
What documents are required to buy the policy?
In most cases, basic information is needed such as business details, nature of work, employee strength, estimated annual wages, and claims history if applicable. Depending on the industry, the insurer may request additional information.
